I'm having a problem with an image I loaded. It's been tagged as a copyright violation. The first link I had was to the candidates site, but the same picture is on a state website. After changing it, the person who put the tag on there changed it from an image problem to a copyright problem.

Now, I'm just not even sure what to do. I've wasted some time trying to fix it, but can't figure out what the hell I need to do. Anyway, if someone could take a look and give me a non-cryptic answer I'd appreciate it. Davidpdx 12:15, 27 March 2006 (UTC)[reply]

Sure, sorry about any frustration you might have had. The problem is the image isn't obviously free to use on wikipedia. While it is now sourced, the source page says "Copyright © Lane County, Oregon. All rights reserved." which implies that they are retaining full copyright. I have tagged the image with a fair use tag, please read the text of the tag, it's a pretty good explanation of what we can do with fair use images. Ideally we would have only freely licensed images, and if one is available you should replace this image with the free one. Fair use images can't be used in some other language wikipedia's for example, and can only be used in English articles according to the fair use criteria. Designers portrait... and work

I have uploaded an image of bruno munari and other designers portraits and their work as industrial designers... i mean objects designed by them... I am not sure about the legality of the images showed in the Compasso d'Oro article... except the logo of the Compasso d'oro prize wich i asume of fair use.... logo.Juan Scott 17:01, 27 March 2006 (UTC)[reply]

You can take a look at the image copyright tag page and see if any of those apply, they seem to be copyrighted images though, so I'm not completely sure we will be able to use them. - cohesion^t 08:29, 28 March 2006 (UTC)[reply]

{{art}} is probably not appropriate, if you think the {{promotional}} tag describes the images that one might be ok. Copyright attaches to creative works when they are created, there is no action required to "copyright" something, so the images are copyrighted. Still, the promotional tag is a fair use tag, and may be ok. It would be better if some wikipedian could take a picture of these objects, but I don't know much about them so that might be impossible. Magazine Page Scan Used to Depict Article's Subject: Image:EGM_SushiX.jpg

Hi, I recently created an article on a prominent character in the video game magazine field, Sushi-X, and added a scan of his picture to the article. I wasn't sure how to tag the image since I'm new, and I didn't know of this page (otherwise I would've inquired about this earlier -- sorry), so I left it untagged. Orphanbot came through, noticed its lack ambiguous licensing and notified me. I'm wondering if this image can be used on wikipedia under Fair Use (I just gave it the newspaper tag since that seemed appropriate -- 100x100px scan from one page of a magazine from 1998) and how it should be tagged. Images :Img_2585.jpg, blkwmtignon.jpg, and Headdress.gif

I don't know what the copyright could be on all of these. I really don't. I would hate for you to delete all of them from my Wiki discussions on the tignon and placage.

They are mostly paintings from state museums and collections; there is one real life photograph from a lecture at the New Orleans Public Library. I don't know how to get in touch with Madame Trevigne, who gave the lecture, because she may be one of the Katrina diaspora.

What would satisfy these questions of legality? Knowing the webpage? On a couple of them, I have shown where I got them from.

The two photographs of paintings are almost certainly OK. Look at the descriptions in Wikipedia:Image_copyright_tags#Public_domain_art and see if any of them apply. The photograph from the lecture is almost certainly copyrighted by the library. Unless you can get a statement from the library that they are willing to allow anyone to use the image (it's not enough just to get permission for Wikipedia), then the image will have to come down. Point of irony translation

I'm translating point d’ironie from the fr wikipedia into Irony mark (not yet posted) and I’m having some trouble with the images. Since they won’t show up in the English version, I've assumed that I have to re-upload the images myself into the English image database. I just wanted to know if you wouldn't mind corroborating whether I've licensed them properly. The fr images all imply that any rights have been forfeited, but the way it is worded varies. When I attempt to indicate that another user has released his rights, the licensing information that appears on the image details implies that it had a copyright that was subsequently released, but the French details indicate that they had no copyright to begin with. The tag that I'm getting in the en details is obsolete, but none of the alternatives given seems to be exactly appropriate (e.g. the template for "uploader releases all rights" is almost it, but I didn’t release them; it was the original uploader from the fr wikipedia who did so).

And as I've uploaded them in en:

Did you take that image? If you did please list that as a source, otherwise we can't verify the claim. Technically though the tag is still there because it hasn't been removed, tag removal is not automatic. Are these subway images legal?

Someone named "Eddie Segoura" has been uploading images of subway cars, such as "Image:R32.jpg", under this template: {{CopyrightedFreeUseProvidedThat}} Is that WikiLegal?

Technically yes, although I think everyone would prefer if he used something more standard like {{cc-by-2.5}}. He may not be aware of that license, but I think it will provide him with something more legally defined than what he is using now, if you want to tell him about it that would be helpful, but if he would rather not for whatever reason what he is doing now isn't against any policies. :) - cohesion^t 02:52, 2 April 2006 (UTC)[reply]

Why are non-free Creative Commons licences not WikiLegal?

It's a somewhat complicated situation, and one where there isn't total agreement among editors. The view on the one side is that we shouldn't include them because they are not GFDL compatible, and as a whole we would like wikipedia to be compatible with that license. (although things can be less restrictive, like public domain images for example) The GFDL does allow for commercial redistribution as long as the work is still licensed under the GFDL, so places like answers.com, which is commercial can use our information. There are some versions of Linux that also would like to include wikipedia as part of their distribution and sell the install disks. In the future as mobile storage becomes smaller and less expensive mobile devices might want a static copy of wikipedia as well, ipods, phones who knows. We don't want our license to get in the way of this. On the other hand we do have fair use images, which are obviously more restricted that non-commercial, and we aren't in any great rush to delete them, so you see the dilemma. Some pages to look at for discussion: email from Jimbo which is usually cited as the policy. Template talk:Noncommercial and Category talk:Non-commercial use only images might be helpful also. Well actualy a (good) fair use rationale can be used for commercial things too as I understand, so it can actualy be slightly less restrictuve (well within the US anyway, most of the world don't have fair use in their laws). Not that most of our fair use images have good claims, but I believe that is the theory behind allowing it. No, it is somewhat odd, mostly the admonition on the page that, "Visitors are kindly requested to observe the Fair Use provisions of the Copyright Act (Sect. 107)" is strange. Are they saying they encourage fair use, or discourage? Hard to say, but it's not entirely relevant either. Fair use may apply regardless of their intentions. So, I tagged the image with {{promophoto}}. Since this person is not alive today, and this does appear to be a publicity shot, I think fair use would apply in this case. The slightly odd copyright declaration on the site is due to copyright wrangles over Immanuel Velikovsky's literary archive: his family contested Velikovsky's will, which had lined up volumes for posthumous publication, and largely prevented further books. The VArchive site was set up by V's former assistant in the shadow of V's family's wrath, but got away with it under Fair Use. ??? No. Making a 2D copy of a 2D work does not constitute original work, effort, or anything else that would justify claiming copyright. PD-self implies that the uploader held the copyright in the first place, in order to release it. What is the origin of the postcard - was it made in Russia or the US? Get a Russian speaker to translate the text at the bottom. Find out what Russian laws apply to works with unknown/anonymous authors. Deletion of Image:Logan.gif

Hi Carnildo. Regarding Image:Logan.gif which was removed today, 7 April 2006, the current (and past--at the time of the photo there) publisher of the monthly "Computing Japan" Magazine in Tokyo, Japan, Mr. Terrie Lloyd, had given authorization for this photo from 1997 to be used on Wikipedia. E-Mail correspondence to that effect is in hand from 17 February 2006. Will this suffice and please kindly advise on the method of image restoration to the page, as well as privately forwarding copy of said e-mail correspondence with headers for your necessary authentication approval. Plasmoid image

I was told my plasmoid image (on the entry "magnetosphere" would be deleted because I did not state the copyright info.

The image is from my article in "Reviews of Geophysics", I designed it at a time I was US Gov. employee. I believe it is therefore in the public domain.

Fair use??

The copyright status of Image:Fodor.jpeg has been questioned. This image appears to originate from Dr. Fodor's home page at Rutger's University. However, it is literally all over the Internet: just about eevery article that mentions Jerry Fodor has this image on it. It seems to me to fall inot the category of a promotional photo (since it is used to promote seminars and and so on even in Italy) and hence qualifies under fair use. If not, I don't see what other possible purpose it could serve except to provide and educational info in order to identify the the person. What is the difficulty here? That's not a great argument for anything. Well that is a real problem, and probably the reason why the upload page says that the majority of the pictures out there are just simply not suitable for use on Wikipedia in big red letters (well black on red anyway). You can try contacting the site that use the image asking where they got it, then contacting theyr source and so on. Alternatively contacting the person pictured might also reveal who took the picture. How to Change A Copyright Tag

First pick the correct tag from Wikipedia:Image copyright tags then go to the image page, click edit at the top of the page, and add that tag to the edit area, including the brackets. so you would type the text {{tag name}} for example. The two images you linked however seem to be from a newspaper, and unless you are a representative of that newspaper you can't allow other people to copy their images. Copywrite tags for Game Screenshots.

I was going to try and put the rest of the pictures that are currently not on the Shining Force page, Shining Force. When I uploaded the first picture Tao0, I put the license as Computer or Video Game Screenshot license. As I wrote the image was given to me from David Hawk Wolinski, it was a picture from his private photo collection. Is that not legal and good enough iinformation? It was indeed written under the image. Hawk Wolinski was the founder and a member of the Madura, witch the article are about. He is himself part of the bands website, witch I administrate. If there's any doubt, or question, he can be contacted and can confirm the information about the picture if its needed

Permission alone isn't actually enough, Wikipedia is licensed under the GFDL, so any images need to be compatible with that license. Permission to use the image on wikipedia isn't enough because we might want to use the image on wikibooks, or print in in a print version, or maybe someone else wants to copy the image to use somewhere else. The copyright holder would need to license it under a free license in order for us to be able to keep it on wikipedia. I received a message from Nivus today telling me to assign a copyright notice to the image. I explicitly mentioned when I uploaded it the status of the image, I don't understand why I'm getting this message. I asked the author of the image what the terms were for using it, he told me it was in the public domain, I mentioned it, it clearly shows this when you go to the Image page... From looking at the page linked, I'm not clear that the image is something other than normal copyright. On the image page, for example Image:Panther3.gif, click edit at the top, this will allow you to edit the image description page, which is separate from any articles that the image may occur in. I am not clear on what you are asking. You have uploaded 2 images under that account, both of which have been deleted due to no source and/or license specification. If you found an image online, you cannot "copyright it", images have a copyright holder, most images online are not suitable for inclusion in wikipedia. my Image

I have recently been told that my image located at http://en.wikipedia.org/wiki/Image:Bob.GIF is to be deleted I have taken the image of the Goomba from approved Nintendo sprites similar to those shown on the site but gave it some of my own touches so technically I created this image in its current form I am to wonder what kind of catagory this falls under. —Preceding unsigned comment added by Bobtherandomguy (talk • contribs)

In addition to not having a license we would need a source for the original image. If the source is copyrighted you cannot make derivative works from it without permission from the copyright holder. I asked User:Tilman permission to upload and use this image of his, and he granted it on his talk page. He specified that he allows it for Wikipedia (and mirrors/clones, printed versions, or CD/DVDs of Wikipedia) only, but not public domain. He doesn't have to "relinquish his intellectual property". Unless he releases his work into the public domain, which is not necessary, he is still the rights holder. You could ask him to release it under a Creative Commons Attribution Sharealike license, for example. This explicitly allows deriviative works and commercial use, but requires that any use is properly attributed (credited), and that any derivative works must be released under the same license (ie, you can't modify it and then not make it similarly free). pfctdayelise (translate?) 01:35, 24 April 2006 (UTC)[reply]

Keep in mind also, that he doesn't have to release his image at all, because it doesn't have to be included in wikipedia. suspected vandalism

I wrote 2 articals and added my own images to each. Then this vadal and his little bot went and deleted both saying they didnt have copyright info. Of course they didn't they are my own. One i made the other was a photo i took. Now i cant even revert it back to the way it was. Is this vandal allowed to just go around ruining others work as he pleases?

The bot acts in a very intermediate step of the well defined image tagging process and in no way deleted the images. The image Image:Ninja symbol.GIF did not specify a license, and the other did not specify a source. For images to be included on wikipedia both license and source have to be specified. If you want to re-upload the images that is fine, but please read and follow the instructions on Special:Upload or the images might get deleted again. Even if you create an image yourself copyright attaches to it, and you still need to license the image for wikipedia. In case anyone's wondering, this is the guy who left this little gem on OrphanBot's userpage. This looks like a screenshot from a film or a tv show, so {{film-screenshot}} or {{tv-screenshot}} would be needed, plus a source. But currently the image isnt used on any pages, and fair use images must be used in an article or else, they will still be deleted. I would just go with {{PD-old}}, the {{PD-art}} is more for photos of 2-D works of art. The currency one it's using now is more for modern currency because some countries copyright their currency, but this isn't fair use because it's so old. My 2 cents anyway! I would argue that this is a photo of a 2-D work of art. It's no longer legal tender, so it's value is as an artifact and a work of art. Aside from that, the limited relief of the coin is no greater than the depth of texture in some oil paintings. On the one hand, the purpose of labeling them is so that the untagged images project can find the images without needing the toolserver or database dumps, and the project is currently seriously backlogged. On the other hand, somewhere over 75% of those images will need to be deleted sooner or later. I'd say the images shouldn't be deleted simply for being in the category for five days. Instead, any admin going through the category should be on the lookout for images that need a {{GFDL-presumed}} or other free-license tag. --Carnildo 07:15, 26 April 2006 (UTC)[reply]

I assume you're talking about Image:Maalus2006jan.JPG? If you took the image yourself, go to 'edit this page' at the top of the image page and enter either {{PD-self}} or {{GFDL}}. Or choose a suitable tag from the ones listed on this page.
I notice that the image is not being used. Unused images may be nominated for deletion, especially if they remain untagged. The JPS 12:11, 28 April 2006 (UTC)[reply]
