I'm having a problem with an image I loaded. It's been tagged as a copyright violation. The first link I had was to the candidates site, but the same picture is on a state website. After changing it, the person who put the tag on there changed it from an image problem to a copyright problem.

Now, I'm just not even sure what to do. I've wasted some time trying to fix it, but can't figure out what the hell I need to do. Anyway, if someone could take a look and give me a non-cryptic answer I'd appreciate it. Davidpdx 12:15, 27 March 2006 (UTC)[reply]

Sure, sorry about any frustration you might have had. The problem is the image isn't obviously free to use on wikipedia. While it is now sourced, the source page says "Copyright © Lane County, Oregon. All rights reserved." which implies that they are retaining full copyright. I have tagged the image with a fair use tag, please read the text of the tag, it's a pretty good explanation of what we can do with fair use images. Ideally we would have only freely licensed images, and if one is available you should replace this image with the free one. Fair use images can't be used in some other language wikipedia's for example, and can only be used in English articles according to the fair use criteria. If you have any other questions let us know. - cohesiont 18:49, 27 March 2006 (UTC)[reply]

Designers portrait... and work

I have uploaded an image of bruno munari and other designers portraits and their work as industrial designers... i mean objects designed by them... I am not sure about the legality of the images showed in the Compasso d'Oro article... except the logo of the Compasso d'oro prize wich i asume of fair use.... logo.Juan Scott 17:01, 27 March 2006 (UTC)[reply]

You can take a look at the image copyright tag page and see if any of those apply, they seem to be copyrighted images though, so I'm not completely sure we will be able to use them. - cohesiont 08:29, 28 March 2006 (UTC)[reply]

The objects belong to the Art work tag ? ... or the promotional? How can I be sure if are copyrighted or not ?Juan Scott 02:26, 30 March 2006 (UTC)[reply]

art is probably not appropriate, if you think the promotional tag describes the images that one might be ok. Copyright attaches to creative works when they are created, there is no action required to "copyright" something, so the images are copyrighted. Still, the promotional tag is a fair use tag, and may be ok. It would be better if some wikipedian could take a picture of these objects, but I don't know much about them so that might be impossible. If it is impossible then the fair use claim would be stronger. - cohesiont 18:56, 30 March 2006 (UTC)[reply]

Magazine Page Scan Used to Depict Article's Subject: Image:EGM_SushiX.jpg

Hi, I recently created an article on a prominent character in the video game magazine field, Sushi-X, and added a scan of his picture to the article. I wasn't sure how to tag the image since I'm new, and I didn't know of this page (otherwise I would've inquired about this earlier -- sorry), so I left it untagged. Orphanbot came through, noticed its lack ambiguous licensing and notified me. I'm wondering if this image can be used on wikipedia under Fair Use (I just gave it the newspaper tag since that seemed appropriate -- 100x100px scan from one page of a magazine from 1998) and how it should be tagged. Thank you :).--Mystical Ninja 14:15, 29 March 2006 (UTC)[reply]

The current tag looks good, and it seems to fall under fair use so everything looks great :) Thanks for helping out. - cohesiont 17:07, 29 March 2006 (UTC)[reply]

Images :Img_2585.jpg, blkwmtignon.jpg, and Headdress.gif

I don't know what the copyright could be on all of these. I really don't. I would hate for you to delete all of them from my Wiki discussions on the tignon and placage.

They are mostly paintings from state museums and collections; there is one real life photograph from a lecture at the New Orleans Public Library. I don't know how to get in touch with Madame Trevigne, who gave the lecture, because she may be one of the Katrina diaspora.

What would satisfy these questions of legality? Knowing the webpage? On a couple of them, I have shown where I got them from.

gab 14:57, 30 March 2006 (UTC)

The two photographs of paintings are almost certainly OK. Look at the descriptions in Wikipedia:Image_copyright_tags#Public_domain_art and see if any of them apply. The photograph from the lecture is almost certainly copyrighted by the library. Unless you can get a statement from the library that they are willing to allow anyone to use the image (it's not enough just to get permission for Wikipedia), then the image will have to come down. If you want to try and get permission from the library, see Wikipedia:Boilerplate request for permission for a form letter to use. Hope that helps. SteinbDJ 15:31, 30 March 2006 (UTC)[reply]

Where can I make the images copyrighted so I won't keep on getting messages that say it will be deleted? —This unsigned comment was added by Oth is luv (talkcontribs) .

Go to Wikipedia:Image_copyright_tags and pick the template that best described the copyright status of the image. Then add that template to the image page. That should take care of it. If you have questions about what template to use, just ask here. SteinbDJ 22:43, 30 March 2006 (UTC)[reply]

Point of irony translation

I'm translating point d’ironie from the fr wikipedia into Irony mark (not yet posted) and I’m having some trouble with the images. Since they won’t show up in the English version, I've assumed that I have to re-upload the images myself into the English image database. I just wanted to know if you wouldn't mind corroborating whether I've licensed them properly. The fr images all imply that any rights have been forfeited, but the way it is worded varies. When I attempt to indicate that another user has released his rights, the licensing information that appears on the image details implies that it had a copyright that was subsequently released, but the French details indicate that they had no copyright to begin with. The tag that I'm getting in the en details is obsolete, but none of the alternatives given seems to be exactly appropriate (e.g. the template for "uploader releases all rights" is almost it, but I didn’t release them; it was the original uploader from the fr wikipedia who did so).

The images in question are: From fr: 1, 2, 3), ([de conviction.jpg|11px]), (4), (5), (6) and (7)

And as I've uploaded them in en:

File:Pointsdironie.jpg, File:11px-Pointdironie-.jpg,  ), ( ), ( ), ( ), ( ) and ( ). Note that the first two images have different wordings in the fr detail pages.

I'd appreciate it if you could let me know what the most appropriate licensing option is. Thanks in advance. Rod ESQ 19:45, 31 March 2006 (UTC)[reply]

Rough translation: "File presented by Xddc. Two signs of Irony of origin thus free of right, that of Agnes B, mine (on which I yield my rights)." Sounds PD to me. <font color="green">A</font>dmrb♉ltz <small>(T | C | k)</small> 20:46, 31 March 2006 (UTC)[reply]

All right, I've found the proper tag for all the images. Should I remove the question from this page, or should I just let someone else archive it? Rod ESQ 23:53, 31 March 2006 (UTC)[reply]

I was thinking, if you're certain its public domain, you should ideally upload it to commons, and then the same image could be used in any language Wikipedia (without local/redundant copies). --Rob 01:41, 1 April 2006 (UTC)[reply]
Yes, if they are public domain or free licensed please upload them them to the commons using the commons upload page. You can then use them on any language wikipedia very easily. - cohesiont 07:10, 1 April 2006 (UTC)[reply]

Hi. I have added the copyright tag to my image Image:Arts centre.JPG Why is the warning still there?

Did you take that image? If you did please list that as a source, otherwise we can't verify the claim. Technically though the tag is still there because it hasn't been removed, tag removal is not automatic. Hope that helps, if you have any other questions let us know :) - cohesiont 09:22, 1 April 2006 (UTC)[reply]

Hi cohesion! How do I list the source?

If you took it you can just say, "I took this image" on the image page under Source :) nothing fancy is required - cohesiont 07:29, 2 April 2006 (UTC)[reply]

I know how to remove the warning now. Thanks

Are these subway images legal?

Someone named "Eddie Segoura" has been uploading images of subway cars, such as "Image:R32.jpg", under this template: CopyrightedFreeUseProvidedThat Is that WikiLegal?

Technically yes, although I think everyone would prefer if he used something more standard like . He may not be aware of that license, but I think it will provide him with something more legally defined than what he is using now, if you want to tell him about it that would be helpful, but if he would rather not for whatever reason what he is doing now isn't against any policies. :) - cohesiont 02:52, 2 April 2006 (UTC)[reply]

Why are non-free Creative Commons licences not WikiLegal?

As stated at Image_copyright_tags.

I asked this first at Wikipedia_talk:Image_copyright_tags#Non_free_creative_commons_licenced_images_-_why_are_they_not_to_be_used. so I guess an answer there would be best? Richard Taylor 17:38, 2 April 2006 (UTC)[reply]

It's a somewhat complicated situation, and one where there isn't total agreement among editors. The view on the one side is that we shouldn't include them because they are not GFDL compatible, and as a whole we would like wikipedia to be compatible with that license. (although things can be less restrictive, like public domain images for example) The GFDL does allow for commercial redistribution as long as the work is still licensed under the GFDL, so places like answers.com, which is commercial can use our information. There are some versions of Linux that also would like to include wikipedia as part of their distribution and sell the install disks. In the future as mobile storage becomes smaller and less expensive mobile devices might want a static copy of wikipedia as well, ipods, phones who knows. We don't want our license to get in the way of this. On the other hand we do have fair use images, which are obviously more restricted that non-commercial, and we aren't in any great rush to delete them, so you see the dilemma. Some pages to look at for discussion: email from Jimbo which is usually cited as the policy. Template talk:Noncommercial and Category talk:Non-commercial use only images might be helpful also. You will also most likely get an answer on Wikipedia talk:Image copyright tags which will probably be helpful. - cohesiont 19:18, 2 April 2006 (UTC)[reply]
Well actualy a (good) fair use rationale can be used for commercial things too as I understand, so it can actualy be slightly less restrictuve (well within the US anyway, most of the world don't have fair use in their laws). Not that most of our fair use images have good claims, but I believe that is the theory behind allowing it. There are some moves to rein things in a bit though, most of our fair use images don't even have a rationale like the policy requires. --Sherool (talk) 19:49, 2 April 2006 (UTC)[reply]

Question

Sorry if I'm just being thick, but I have read pagefuls of stuff and I still have no clue what tag I'm supposed to put on image Image:Ivfn.jpg. The image page already gives all the info I have about its status/--feline1 10:20, 3 April 2006 (UTC)[reply]

No, it is somewhat odd, mostly the admonition on the page that, "Visitors are kindly requested to observe the Fair Use provisions of the Copyright Act (Sect. 107)" is strange. Are they saying they encourage fair use, or discourage? Hard to say, but it's not entirely relevant either. Fair use may apply regardless of their intentions. So, I tagged the image with promophoto. Since this person is not alive today, and this does appear to be a publicity shot, I think fair use would apply in this case. Thank you for being so complete in the sourcing :D - cohesiont 17:40, 3 April 2006 (UTC)[reply]
The slightly odd copyright declaration on the site is due to copyright wrangles over Immanuel Velikovsky's literary archive: his family contested Velikovsky's will, which had lined up volumes for posthumous publication, and largely prevented further books. The VArchive site was set up by V's former assistant in the shadow of V's family's wrath, but got away with it under Fair Use. The site has now been itself been legitimized as V's daughters donated all his archive to Princeton University.--feline1 18:08, 3 April 2006 (UTC)[reply]

What do I do about this photo???

I recieved the following email from OrphanBot concerning this image - Image:Little_Humpbacked_Horse_-Tsar_Maiden_-Tamara_Karsavina_-1895.jpg

QUOTE - "The image has been identified as not specifying the source and creator of the image, which is required by Wikipedia's policy on images. If you don't indicate the source and creator of the image on the image's description page, it may be deleted some time in the next seven days. If you have uploaded other images, please verify that you have provided source information for them as well."

I do not see how on earth this image could have a copyright. What should I do???? —This unsigned comment was added by Mrlopez2681 (talkcontribs) .

IC - I scanned this image myself, I have it on a photographic postcard. What tag do I add for that? Mrlopez2681 11:44, 4 April 2006 (UTC)[reply]

Are you sure? Does scanning the image amount to creating the work and allowing the user discretion to release it into the public domain? The JPS 20:09, 6 April 2006 (UTC)[reply]
If it is scanned from their own personal collection, I am fairly confident that its OK. Admrb♉ltz (T | C | k) 20:36, 6 April 2006 (UTC)[reply]
??? No. Making a 2D copy of a 2D work does not constitute original work, effort, or anything else that would justify claiming copyright. PD-self implies that the uploader held the copyright in the first place, in order to release it. What is the origin of the postcard - was it made in Russia or the US? Get a Russian speaker to translate the text at the bottom. Find out what Russian laws apply to works with unknown/anonymous authors. Just because it looks old doesn't mean it's public domain! pfctdayelise (translate?) 00:41, 7 April 2006 (UTC)[reply]

Deletion of Image:Logan.gif

Hi Carnildo. Regarding Image:Logan.gif which was removed today, 7 April 2006, the current (and past--at the time of the photo there) publisher of the monthly "Computing Japan" Magazine in Tokyo, Japan, Mr. Terrie Lloyd, had given authorization for this photo from 1997 to be used on Wikipedia. E-Mail correspondence to that effect is in hand from 17 February 2006. Will this suffice and please kindly advise on the method of image restoration to the page, as well as privately forwarding copy of said e-mail correspondence with headers for your necessary authentication approval. Thanks again! --Dango

Did Mr Lloyd give permission for it to be licensed under a free license, such as GFDL or PD? If not, then you must add Withpermission AND a valid Fair Use tag, such as promotional. Thanks Admrb♉ltz (T | C | k) 16:21, 7 April 2006 (UTC)[reply]

Plasmoid image

I was told my plasmoid image (on the entry "magnetosphere" would be deleted because I did not state the copyright info.

Fair use??

The copyright status of Image:Fodor.jpeg has been questioned. This image appears to originate from Dr. Fodor's home page at Rutger's University. However, it is literally all over the Internet: just about eevery article that mentions Jerry Fodor has this image on it. It seems to me to fall inot the category of a promotional photo (since it is used to promote seminars and and so on even in Italy) and hence qualifies under fair use. If not, I don't see what other possible purpose it could serve except to provide and educational info in order to identify the the person. What is the difficulty here? It's ALL OVER THE PLACE.--Lacatosias 12:58, 8 April 2006 (UTC)[reply]

That's not a great argument for anything. Friends, jumping off cliffs, etc. Even downloading mp3s, yet individuals being sued by multinationals, etc. Just because the internet at large has no respect for copyright doesn't mean that we don't. pfctdayelise (translate?) 14:49, 8 April 2006 (UTC)[reply]
Fine. Here's a serious question though: how does one go about finding out the copyright status of an image when it is not explicitly declared (that is, about 99% of the time)?--Lacatosias 15:15, 8 April 2006 (UTC)[reply]
Well that is a real problem, and probably the reason why the upload page says that the majority of the pictures out there are just simply not suitable for use on Wikipedia in big red letters (well black on red anyway). You can try contacting the site that use the image asking where they got it, then contacting theyr source and so on. Alternatively contacting the person pictured might also reveal who took the picture. More serious sites also generaly include photo credit of some sort for images they use. --Sherool (talk) 15:27, 8 April 2006 (UTC)[reply]
Alright. I'll see what I can do.--Lacatosias 15:32, 8 April 2006 (UTC)[reply]
But wait, I am confused. You tagged it promophoto and no one is complaining about that. No one has argued it doesn't qualify as fair use. So... you don't necessarily have to do anything. pfctdayelise (translate?) 16:21, 8 April 2006 (UTC)[reply]
Oh, well then, does it qualify as fair use in your opinion? I'm still compltely unclear about the question of what is promotional material and what isn't and, while I tried to make the case, I'm not an expert in these matters.--Lacatosias 16:28, 8 April 2006 (UTC)[reply]

How to Change A Copyright Tag

How do I change the copyright tag of an image? EZZIE 22:33, 11 April 2006 (UTC) For example IMAGE:Article01.JPG and IMAGE:Article02.JPG are allowed to be copied but I didn't uload it with that information. —The preceding unsigned comment was added by Sevenlinefeatures (talkcontribs) .

First pick the correct tag from Wikipedia:Image copyright tags then go to the image page, click edit at the top of the page, and add that tag to the edit area, including the brackets. so you would type the text tag name for example. The two images you linked however seem to be from a newspaper, and unless you are a representative of that newspaper you can't allow other people to copy their images. Gao

Hello

As I wrote the image was given to me from David Hawk Wolinski, it was a picture from his private photo collection. Is that not legal and good enough iinformation? It was indeed written under the image. Hawk Wolinski was the founder and a member of the Madura, witch the article are about. He is himself part of the bands website, witch I administrate. If there's any doubt, or question, he can be contacted and can confirm the information about the picture if its needed

Gao —Preceding unsigned comment added by Gaok (talkcontribs)

Permission alone isn't actually enough, Wikipedia is licensed under the GFDL, so any images need to be compatible with that license. Permission to use the image on wikipedia isn't enough because we might want to use the image on wikibooks, or print in in a print version, or maybe someone else wants to copy the image to use somewhere else. The copyright holder would need to license it under a free license in order for us to be able to keep it on wikipedia. If you have any other questions let us know. - cohesion 17:40, 15 April 2006 (UTC)[reply]

I asked User:Tilman permission to upload and use this image of his, and he granted it on his talk page. He specified that he allows it for Wikipedia (and mirrors/clones, printed versions, or CD/DVDs of Wikipedia) only, but not public domain. I couldn't find a tag that seems to specifically apply to this. I uploaded it anyway with an explanation, but it wants a tag. Help! wikipediatrix 14:11, 23 April 2006 (UTC)[reply]

That's because "Wikipedia only" and similar licenses are not allowed. They're not strong enough to allow proper redistribution and reuse rights to other users. So you best ask Tilman to reconsider, or find a free alternative. pfctdayelise (translate?) 00:45, 24 April 2006 (UTC)[reply]
I don't get it. Why should he have to relinquish his intellectual property in order to permit Wikipedia to use it? It's his image, he should be able to say who can and cannot use it. He says Wikipedia can use it, so what's the problem?? wikipediatrix 01:00, 24 April 2006 (UTC)[reply]
From WP:IUP: For a list of possible licenses which are considered "free enough" for Wikipedia, see Wikipedia:Image copyright tags. Licenses which restrict the use of the media to non-profit or educational purposes only (i.e. noncommercial use only), or are given permission to only appear on Wikipedia, are not free enough for Wikipedia's usages or goals and will be deleted.[8]. [...] In short, Wikipedia media (with the exception of "fair use" media — see below) should be as "free" as Wikipedia's content — both to keep Wikipedia's own legal status secure as well as to allow for as much re-use of Wikipedia content as possible.
He doesn't have to "relinquish his intellectual property". Unless he releases his work into the public domain, which is not necessary, he is still the rights holder. You could ask him to release it under a Creative Commons Attribution Sharealike license, for example. This explicitly allows deriviative works and commercial use, but requires that any use is properly attributed (credited), and that any derivative works must be released under the same license (ie, you can't modify it and then not make it similarly free). pfctdayelise (translate?) 01:35, 24 April 2006 (UTC)[reply]
Keep in mind also, that he doesn't have to release his image at all, because it doesn't have to be included in wikipedia. Wikipedia is a "free encyclopedia", so it is very likely that people won't want to make their images "free", and thus shouldn't be included. - cohesion 17:45, 24 April 2006 (UTC)[reply]

UTV images

It's not me who has permission for the pictures, it's another member of Wikipedia: (http://en.wikipedia.org/wiki/User:Keithgreer). --GarryMc 16:33, 23 April 2006 (UTC)[reply]

suspected vandalism

I wrote 2 articals and added my own images to each. Then this vadal and his little bot went and deleted both saying they didnt have copyright info. Of course they didn't they are my own. One i made the other was a photo i took. Now i cant even revert it back to the way it was. Is this vandal allowed to just go around ruining others work as he pleases?

The bot acts in a very intermediate step of the well defined image tagging process and in no way deleted the images. The image Image:Ninja symbol.GIF did not specify a license, and the other did not specify a source. For images to be included on wikipedia both license and source have to be specified. If you want to re-upload the images that is fine, but please read and follow the instructions on Special:Upload or the images might get deleted again. Even if you create an image yourself copyright attaches to it, and you still need to license the image for wikipedia. If you have any other questions let us know. - cohesion 18:09, 24 April 2006 (UTC)[reply]
In case anyone's wondering, this is the guy who left this little gem on OrphanBot's userpage. If he'd been polite about it, rather than making personal attacks, I'd have told him that OrphanBot's kept a copy of both images, and that I'd be more than willing to re-upload the images for him. --Carnildo 23:31, 23 April 2006 (UTC)[reply]

Dale Brown Photo

I submitted a copyright justification for my picture when I uploaded it. I copied and pasted the same ones used for other Sports Illustrated covers found on other webpages.

Please check the image site because it's there. I hope I did it correctly. —The preceding unsigned comment was added by Jgp3553 (talkcontribs) .

The proper template (not copy and paste) would be Magazinecover Admrb♉ltz (tcbpdm) 21:55, 25 April 2006 (UTC)[reply]

Copyrighting the images

To whom it may concern,

This is Shadeed A. Kelly a.k.a. user "King Shadeed". I'm having trouble copyrighting the new Columbia Pictures Television image. I didn't see the copyright option below the last time. Where is it? And how do I get to select the red copyright symbol whenever I copyright any image I send?

Sincerely,

"King Shadeed"

Please use tv-logo. Thanks. Admrb♉ltz (tcbpdm) 21:57, 25 April 2006 (UTC)[reply]

Image help

Hi ill go to the point i recently uploaded an image of the dark mark for the dark mark page but i got a notice about it being deleted within 7 days if i cant find the copywright i have no idea where to find it so if possible could anyone you know find it or if you could tell me my email is many thanks --Drek258 21:47, 25 April 2006 (UTC)[reply]

This looks like a screenshot from a film or a tv show, so film-screenshot or tv-screenshot would be needed, plus a source. But currently the image isnt used on any pages, and fair use images must be used in an article or else, they will still be deleted. Admrb♉ltz (tcbpdm) 21:54, 25 April 2006 (UTC)[reply]

Old coin image

Image:Kings_of_Macedon,_Philip_V_221-179_BC.jpg

I think the current tag is incorrect. What do we think about pd-art? --Dante Alighieri | Talk 23:09, 25 April 2006 (UTC)[reply]

Its still a coin, and the current tag should suffice; but I see your point regarding its age... any one else have an opinion? Admrb♉ltz (tcbpdm) 02:46, 26 April 2006 (UTC)[reply]
I would just go with PD-old, the PD-art is more for photos of 2-D works of art. The currency one it's using now is more for modern currency because some countries copyright their currency, but this isn't fair use because it's so old. My 2 cents anyway! (worst joke you will hear all day!) - cohesion 17:11, 26 April 2006 (UTC)[reply]
I would argue that this is a photo of a 2-D work of art. It's no longer legal tender, so it's value is as an artifact and a work of art. Aside from that, the limited relief of the coin is no greater than the depth of texture in some oil paintings. Fundamentally, we're dealing with a 2-D work of art here... at least, that's my analysis. --Dante Alighieri | Talk 22:08, 26 April 2006 (UTC)[reply]

Regarding untagged

Should these images be speedied after 5 days? Or do they all have to be resorted manually into no source and nolicense? --Rory096(block) 23:47, 25 April 2006 (UTC)[reply]

I believe it would still be a WP:CSD Admrb♉ltz (tcbpdm) 02:43, 26 April 2006 (UTC)[reply]
On the one hand, the purpose of labeling them is so that the untagged images project can find the images without needing the toolserver or database dumps, and the project is currently seriously backlogged. On the other hand, somewhere over 75% of those images will need to be deleted sooner or later. I'd say the images shouldn't be deleted simply for being in the category for five days. Instead, any admin going through the category should be on the lookout for images that need a GFDL-presumed or other free-license tag. --Carnildo 07:15, 26 April 2006 (UTC)[reply]

Album Cover

Hi, I forgot to add a copyright tag to Image:Re-Up (The Compilation).jpg. However, after realizing my mistake, I re-uploaded the file at Image:Re-Up The Compilation.jpg and chose "album cover" under copyright status. Please delete the first image, as I've already used the second in Ras Kass Presents... Re-Up (The Compilation). Thanks. —The preceding unsigned comment was added by Stillblade (talkcontribs) .

I assume you're talking about Image:Maalus2006jan.JPG? If you took the image yourself, go to 'edit this page' at the top of the image page and enter either PD-self or GFDL. Or choose a suitable tag from the ones listed on this page.
I notice that the image is not being used. Unused images may be nominated for deletion, especially if they remain untagged. The JPS 12:11, 28 April 2006 (UTC)[reply]
