Location and general description of property.—The railroad of The Tuskegee Railroad Company, hereinafter called the carrier, is a single-track standard-gauge steam railroad, located in eastern Alabama and extending from a connection with the tracks of The Western Railway of Alabama at Chehaw to the end of the line at Tuskegee, a distance of 5.713 miles.[1]


CORPORATE HISTORY

The carrier was incorporated October 8, 1902, under the general laws of the State of Alabama, for the purpose of acquiring a railroad owned by E. T. Varner & Company, which was done. The railroad acquired from E. T. Varner & Company was originally incorporated February 20, 1860, under special act of the State of Alabama, as the Tuskegee Rail Road Company. On January 7, 1869, the property, rights, and franchises of that company were sold at sheriff's sale to William G. Swanson and others, who entered into an agreement with E. T. Varner & Company, in February, 1871, for the reconstruction of the road between Chehaw and Tuskegee, Ala., and equipping it by January, 1872, upon fulfillment of which they would transfer all right, title, and interest in the property to E. T. Varner & Company. This agreement was consummated by deed dated January 2, 1872. After the acquirement of the property by E. T. Varner & Company it was operated by them under the name of "The Tuskegee Railroad Company," a partnership, until it was sold and conveyed to the carrier by deed dated October 18, 1902. The date of organization of the carrier was October 8, 1902.[1]

DEVELOPMENT OF FIXED PHYSICAL PROPERTY

The owned mileage of the carrier, 5.713 miles, was acquired partly by construction and partly by purchase, as indicated in the following statement.
