Replaceable fair use File:Kyung-wha Chung Portrait.jpg edit

 

Thanks for uploading File:Kyung-wha Chung Portrait.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{Di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

  1. Response to Regarding Fair Use Image Kyung-wha Chung and Ji Young Lim

Hello Whpq! Thank you so much for your messages with the above two pictures. I am an artist representative from Music and Art Company, an agency for both Kyungwha Chung and Ji Young Lim. I was requested by the artist themselves that the pictures that are being currently used in Wikipedia are not a correct representation of them visually, and any copyright-free material also does not meet that requirement. Since these are the photos of the living individual, I understand that their own intent is highly valued. Specifically, the photo being currently used for Kyungwha Chung in all language Wikipedia pages are actually taken in "situations where the subject did not expect to be photographed" which is against Wikipedia regulation. Unfortunately, I'm not well versed in technology (and my artists as well) and don't know how to delete those photos themselves so I request your help. Regarding the copyright issue in the Juilliard website, the agency owns the photo and provided the photo to the Juilliard School. I request this image to be deleted in the Wikimedia Commons as it is not freely copyrighted and to be uploaded under "fair usage" in Wikipedia in English and Korean Wikipedia page for Kyung Wha Chung (정경화). The subject is clearly sitting for autograph signings in File:Kyung-wha Chung at SSO (20151005224117).jpg. It is perfectly reasonable to expect somebody to take a photo of the person signing autographs. If the subject prefers a different picture, then she or her representative can provide a freely licensed image although there is no guarantee that the image would be used. -- Whpq (talk) 01:57, 18 August 2020 (UTC)Reply
You are correct that it is taken during the signing, but it is also clearly not when she posed for it. Editors must take particular care when adding information about living persons to any Wikipedia page. Such material requires a high degree of sensitivity and must adhere strictly to all applicable laws in the United States, and it is clearly not consented material to be published in such a highly renowned and used platform like Wikipedia. The photo also appears the very first in any Google search with her name, appearing way before any promotional materials, damaging the brand identity of her musicianship not to mention that she herself is not happy with it (if you see the photo, you will hopefully understand why). I am replacing it with a much better quality photo that contributes to the Wikipedia community. The only rule I am required to follow is as below: WP:BLPSELF WP:BLPCOMPLAIN WP:BLPSPS
There are living persons who publish material about themselves, such as through press releases or personal websites. Such material may be used as a source only if:
it is not unduly self-serving;
it does not involve claims about third parties;
it does not involve claims about events not directly related to the subject;
there is no reasonable doubt as to its authenticity; and
the article is not based primarily on such sources.

Regarding the use of the photograph, there is no requirement that the subject agrees to pose for or allow the use of the photo. It is a freely licensed photo and is not demeaning or derogatory in any way so there is no issue with its use here on Wikipedia based on policy. That the subject doesn't like the photo is not a good reason to remove a freely licensed image in use in the article. If you or the subject is unhappy with the Google search results, then you need to take that up with Google. Wikipedia does not control Google's search results. As for replacing the image with the one you uploaded, as already explained, a non-free image for a living person is not acceptable per WP:NFCC#1. If the subject does not like this image, then the solution is to upload a freely licensed one that she does like. I doubt there would be much objection to such an image. As somebody who reviews quite a lot of uploaded images here, I've seen many publicity photos provided under a free license by following Wikipedia:Donating copyrighted materials. -- Whpq (talk) 13:22, 18 August 2020 (UTC)Reply

The nature of your edits, such as the one you made to Kyung Wha Chung, gives the impression you have an undisclosed financial stake in promoting a topic, but you have not complied with Wikipedia's mandatory paid editing disclosure requirements.   1. Regarding Paid Work for Client

I am currently an unpaid/uncompensated (except for experience) internship for the agency, and mainly doing all the translation and interpretation related work as a volunteer. If I get paid later on by any chance, I will make sure to disclose that information on my profile. I have been a personal fan for her for more than a decade and contacted the company to get the approval for editing and uploading this Wikipedia page. As of now, the truth is I am doing this entirely for a goodwill and my personal passion for Kyung Wha Chung's artistic expertise and legacy. So what, if I receive a compensation and disclose it on my wall you will not revert my edits citing as "vandalism" when I'm clearly citing a correct and valid citation, including artists that are not part of the agency I'm working for? Firstly, let me clarify that none of the reverts were for vandalism as you claim. Wikipedia is an encyclopedia and not a directory service. Listing the managing agency doesn't belong in an encyclopedia article. That was why it was reverted, including reverting for an agency you don't work for.
