You may have took the image (we cannot tell), but it was on the internet before being uploaded here (http://sfluxe.com/2008/11/08/look-of-the-day-marcy-carmack-and-alan-malouf/) - therefore we cannot take it without permission from the original web site.  Ronhjones  (Talk) 00:04, 16 February 2012 (UTC)Reply

I've removed File:James Maslow, Sam Zachrich Photography, July 2014.jpg from the James Maslow article because it is a non-free image. Even if an image is licensed for use on Wikipedia, it can't be used on derivative works, so that means it's subject to the same limitations of any other fair-use image. The guidelines for biographies of living people are very clear that non-free images should not be used to illustrate the subject.

If a low-resolution version of the image were made available under a free license, that could be used in the infobox (and in all derivative works of Wikipedia). —C.Fred (talk) 20:19, 1 October 2014 (UTC)Reply

If I own the license to this photo (from the photographer), is there a way to upload it on wiki?

Let me make sure I understand this:
  1. The photographer has given (assigned, sold, etc.) you the license for the image.
  2. You are willing to relicense it under a free license such as CC-BY-SA 3.0 (Creative Commons sharealike with attribution).
If you answer both of those yes, it is possible to upload the image to Wiki. If the answer to either question is no, then you may not upload it, because we may not use it. —C.Fred (talk) 20:28, 1 October 2014 (UTC)Reply

However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

  1. Go to the file description page and add the text {{di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
  2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

Alternatively, you can also choose to replace this non-free media item by finding freely licensed media of the same subject, requesting that the copyright holder release this (or similar) media under a free license, or by creating new media yourself (for example, by taking your own photograph of the subject).
