HR 5122 edit

Hello; I noticed you happen to be editing the article on HR 5122 as we speak. Since it is an omnibus defense authorization bill, providing funding for all military and defense operations, it's a little narrow to say it "replaced" anything; also, the Insurrection Act has existed since 1807, and has always trumped Posse Comitatus. The Posse Comitatus Act came about in 1878, after reconstruction; it included an explicit exemption for Constitutional authority and "Act[s] of Congress", which both the Insurrection Act and the 2007 NDAA (HR5122) are. In any case, all of the Insurrection Act amendments were repealed in 2008, four months ago. Even when the 2006 amendments were in effect, they still had very specific conditions that must have been met. It's a common misconception that the amendments allowed the President to arbitrarily declare martial law as a result of any "other condition" or an arbitrary "emergency". In reality, the same prerequisites for any application of the Insurrection Act must still be met, including an additional provision. Please see the description of the changes and flowchart. In any case, all of these changes have been repealed in the 2008 NDAA, and the Insurrection Act is back to exactly the way it has been for the prior two centuries.
