It is likely that it would be considered an analog (of DOB), in which case, sales for human consumption or possession with the intent to ingest could be prosecuted under the Federal Analogue Act though there has been no subsequent court cases which prove that DOC can actually be prosecuted under this act. I apologize for the misunderstanding, what I was trying to say is that the article cannot say that DOC can for sure be prosecuted under the Analog Act. If you're familiar with chemistry, pretty much anything can be considered an analog of another drug. Just because the DOJ says that it's an analog doesn't make it an analog drug; it only makes it a likely analog, A proper wording be "the United States DOJ considers it an analog drug".
