Wikipedia and copyright

Hello BabylonTheGreat! Your additions to Mara Orendain La Torre have been removed in whole or in part, as they appear to have added copyrighted content without evidence that the source material is in the public domain or has been released by its owner or legal agent under a suitably-free and compatible copyright license. To be used on Wikipedia, all other images must be made available under a free and open copyright license that allows commercial and derivative reuse.
• If you own the copyright to the source you want to copy or are a legally designated agent, you may be able to license that text so that we can publish it here. Understand, though, that unlike many other sites, where a person can license their content for use there and retain non-free ownership, that is not possible at Wikipedia. Rather, the release of content must be irrevocable, to the world, into either the public domain (PD) or under a suitably-free and compatible copyright license. Such a release must be done in a verifiable manner, so that the authority of the person purporting to release the copyright is evidenced. See Wikipedia:Donating copyrighted materials.
• Also note that Wikipedia articles may not be copied or translated without attribution. Thanks for uploading File:Mara Orendain La Torre.jpg. I noticed that this file is being used under a claim of fair use. However, I think that the way it is being used fails the first non-free content criterion. This criterion states that files used under claims of fair use may have no free equivalent; in other words, if the file could be adequately covered by a freely-licensed file or by text alone, then it may not be used on Wikipedia. If you believe this file is not replaceable, please:

1. Go to the file description page and add the text {{Di-replaceable fair use disputed|<your reason>}} below the original replaceable fair use template, replacing <your reason> with a short explanation of why the file is not replaceable.
2. On the file discussion page, write a full explanation of why you believe the file is not replaceable.

If you are the copyright holder for this media entirely yourself but have previously published it elsewhere (especially online), please either

• make a note permitting reuse under the CC-BY-SA or another acceptable free license (see this list) at the site of the original publication; or
• Send an email from an address associated with the original publication to permissions-en@wikimedia.org, stating your ownership of the material and your intention to publish it under a free license. You can find a sample permission letter here. If you take this step, add {{OTRS pending}} to the file description page to prevent premature deletion.

If you did not create it entirely yourself, please ask the person who created the file to take one of the two steps listed above, or if the owner of the file has already given their permission to you via email, please forward that email to permissions-en@wikimedia.org.

Since you're now claiming that this image comes from Flickr, please add a link to the Flickr account where you found the image to the file's page so that its licensing can be verified. Simply stating it comes from Flickr isn't going to be sufficient and there needs to be some way to verify the file's licensing. In addition (and this part is very important), you're going to need to show that the image was first published on Flickr by its copyright holder under such a license before it was subsequently published anywhere else under a different license in order to eliminate any Flickr washing concerns. Media organizations do sometimes take photos they find on Flickr and use them in articles, but it needs to be clearly shown that the file had been previously been released under a free license that Wikipedia accepts. If it can be shown that this file has been released under a {{cc-zero}} or any other free license that Wikipedia accepts, then the upload should probably be tagged for a move to Commons since that's a better place to for such licenses to be hosted. -- Marchjuly (talk) 12:26, 8 February 2022 (UTC)

The link you provided to Flickr states that photo was uploaded to Flickr on February 8, 2022. The file was first uploaded to Wikipedia on November 25, 2021, as File:Mara Orendain La Torre.jpg and can be seen here uploaded to Instagram on November 18, 2021. Both of these publications precede the file being uploaded to Flickr which means that Flickr account is almost certainly not the original source of image; moreover, the Flickr account states it was created in 2022 which again shows it can't be the original source of the image. So, you're going to need the copyright holder of the photo (for reference, the copyright holder of a photo is the person who takes it, not the subject of the photo) to email their WP:CONSENT to Wikimedia VRT for this image to be kept. If, by chance, you mistakenly assumed that all that was needed was for the file to be uploaded to Flickr after it's been previously published somewhere else online, then that was a mistake. An image previously published online under one license can't subsequently be uploaded to Flickr and then re-released under a different license. Such a thing is considered to be license laundering and such licenses aren't considered valid by Wikipedia. I'm going to assume you meant no real harm here and this was just a good faith mistake based upon a misunderstanding as to how copyright works; however, you should be advised that this is the kind of thing that can lead to an account being blocked by a Wikipedia administrator if it's established that it was intentionally done to try and mislead or deceive others. -- Marchjuly (talk) 13:57, 8 February 2022 (UTC)
