Hi! Thanks for the note. I'm not 100% sure what you're referring to, as you haven't linked to any articles or specified which image you're talking about, but I think you're referencing The White Eagles, Black Indians of New Orleans (1980) by Marilyn Nance. As I explained when the artist requested the image be removed (see my November talk archive), permission is not required for images utilized on Wikipedia under fair use, provided Wikipedia's non-free content guidelines have been followed (see Wiki:NFC (Images)). The photograph in question was displayed publicly at the National Gallery of Art; I made the reproduction in person; the image has been reduced in size to honor the artist's commercial rights; ownership of the copyright and physical work have both been noted and included in the listing; the work is contextually significant, demonstrating a key style and subject matter the artist has explored; and it is only being used in one instance across all WikiMedia sites.
As I explained to the artist, I understand not wanting to have images of your art used on Wikipedia. But permission is explicitly not required for images under fair use if the NFC rules have been followed. --19h00s (talk) 12:54, 23 December 2022 (UTC)
