  • On 2009-01-08 Jennifer Cowan filed a "Petitioner's Submissions For The January 5, 2008 Joint Filing In Response To The Court's December 17, 2008 Order" with regard to ISN 26 ISN 27 ISN 29 ISN 31 ISN 32 ISN 35 ISN 36 ISN 37 ISN 38 ISN 39 ISN 40 ISN 41 ISN 42 ISN 43 ISN 44 ISN 63 ISN 91 ISN 251 in Civil Action No. 04-cv-1194, 04-cv-1254, 05-cv-0023, 05-cv-2386, 05-cv-0280, 05-cv-0520, 05-cv-0748, 05-cv-1555, 05-cv-1638, 05-cv-1971, 05-cv-2185, 05-cv-2223, 05-cv-2386, 07-cv-2337, 08-cv-1923 (TFH).[2]
  • The attorneys for these captives opposed the United States Department of Justice proposal to amalgamate these petitions.[2] They called the proposal a "motion in disguise". They noted that the DoJ sent this proposal by email, without giving them sufficient time to respond, and then told the court it was a joint proposal of both the DoJ and the captives. The DoJ's sole justification for amalgamating the petitions was that the men were captured fleeing Afghanistan at roughly the same time and place. The captives' attorneys noted many differences between these captives, like that some were accused of being "fighters", while others were not, that they came to Afghanistan at various times, and various places, and conducted different activities while there. Some were accused of training at Afghan training camps, while others were not. Some were accused of ties to the Taliban, or to al Qaeda, while others were accused of neither.
