Merger Proposal

I propose that Dukes v. Wal-Mart Stores, Inc. be merged into Wal-Mart v. Dukes because they are one and the same case, the former being the lower and appellate court case name and the latter being the Supreme Court case name. The Supreme Court decision will vacate any lower court decisions, which weighs in favor of maintaining only the Wal-Mart v. Dukes page. Relevant portions of the existing Dukes v. Wal-Mart Stores, Inc. article can be incorporated as part of the Wal-Mart v. Dukes article's procedural history section. Tony (talk) 06:07, 4 March 2011 (UTC)Reply

It really depends. If (as is likely will be the case) the Supreme Court reverses, then merger of the two articles is appropriate, because without the class certification, the underlying Dukes suit will disappear and won't be independently notable, and can be subsumed into the discussion of this case. If the Supreme Court affirms, the lower-court case will continue, and will be independently notable as a gigantic employment discrimination suit, while the Supreme Court case will be independently notable as a procedural precedent. Proper Short Name?
