Appearance of the song in the 1935 film

This article states that the song (The man who broke the bank ... etc) appeared in the film of the same name. However, the Wikipedia article on Francis, Day & Hunter Ltd v Twentieth Century Fox Corp makes reference to a court judgment in which it is said that part of the claim failed because "neither the song nor the music was performed in the film".
