The MPAA is accusing Hogan of making Meet the Fockers "available for download."

This is "uploading" or distributing -- not "downloading." That he owns a copy is not only irrelevent as a defense but may point to the source of the distributed file.

I have no sympathy nor do I support the MPAA and RIAA position but in fact in the US not a single person has ever been sued by the RIAA or MPAA for downloading protected content. On any given day any (or every) web surfer, or recepient of email may be "downloadng protected content. There is no method of proving intent.

The MPAA and RIAA are happy to continue the confusion as their aim is to chill downloaders as well as downloaders, but wikipedia needs to be precise.

Again, in Hogan's case the precise accusation is "making available for download."IDD55 01:36, 8 August 2006 (UTC)Reply
