English case law referring is Dunlop; Bourgoin SA; Jones v Swansea City Council and Elguzouli-Daf v Commissioner of Police of the Metropolis [1995] 2 QB 335 at 346-347 per Steyn LJ. In this case the UK High Court found that malice could be made out if the act were done with an actual intention to cause injury. Malice could be shown if the act were done in the knowledge of invalidity or lack of power and with knowledge that it would cause or be likely to cause injury. Malice would also exist if the act were done with reckless indifference or deliberate blindness to that invalidity or lack of power and that likely injury. These elements, with respect, are consistent with the views of the majority albeit that some of those views were expressed tentatively having regard to the basis upon which the case before them was presented.

    • Yes, I thought of it, but unfortunately now the general use is linked to "law" anyway, see eg Villain or Empathy. I dont think that in common parlance the term differs from its legal meaning much and the situation may be remedied by slightly editing the lede by throwing in a couple of dicdefs and then switching to legalese.   • Hmm. WikiNav for the current list indicates that only 46 out of 396 clicks (~12%) went to the proposed primary topic, and it wasn't at the top of the list either (the '93 film is). Mass views for the current list indicates that Michael Malice, the aforementioned film and No Malice all have substantially more views generally compared to the legal concept.   • Oppose per Joy's data: only a small fraction of readers seek this topic when they search for "Malice", so it's not the primary topic with respect to usage. Add to that concerns about the narrow scope of the legal concept as opposed to the everyday meaning, and the fact that the encyclopedia doesn't necessarily follow a dictionary hierarchy anyway... Also, only about a third of the links for "malice" appear to intend the legal concept [1]. – Uanfala (talk) 11:38, 28 January 2023 (UTC)Reply
