Two articles on Agency law

We have two nearly identical articles:

I'm not sure exactly what the scope of the first article (this one) is supposed to be. The second I believe only applies to the U.K. (and I assume not Australia, New Zealand or Canada). However the first article (this one) has many of the same cases as the second, yet it also has citations to Restatement of Agency, which is American law.

I don't know enough about the difference of the various notion of agency internationally to know what needs to be done to the first article... --David Tornheim (talk) 10:00, 10 March 2017 (UTC)

As the English-speaking countries you mention all took their (post-colonisation) legal systems from the English one, there is a lot of reference in the case law to English cases even in the former colonies. I can't be more specific but I imagine that is the reason.
As to what is to be done, I would say divide the general article into a) common-law jurisdictions such as the Anglophone ones you mention b) Islamic law [nothing there yet] and c) Roman law based jurisdictions (such as most of Europe) [nothing there yet?]

Partnerships and Companies

This section seems to be a bit of a mess. I would propose two sections: agency in partnerships, and agency in companies. On the latter we should definitely cover directors as agents for the company; and possibly the history of the company before incorporation became common, as complex agency contracts with limited indemnity. On the former it would be good to have a Scots lawyer clarify agency in Scottish firms: the firm is a legal person in its own right, but as the partners are liable if the firm's assets are exhausted, I suspect they may be agents of each other as well as of the firm per se.
