I decided this article needs a lot of work. This is one of those terms bandied about by lawyers that other people probably don't understand so a good article would be helpful.
Recognizing that, I just put a good stream of thought down and hope folks will add to it.

A few years ago, an aunt sued her minor niece or nephew for an accident, and was castigated in the media for it; the purpose of her lawsuit, though, was to establish a liability against which the defendant was insured, the insurance company apparently unwilling otherwise to pay the damages. Is this a friendly suit? I don't believe the insurance company was formally a party, but presumably could have been subrogated if necessary. 132.170.212.17 (talk) 17:04, 10 January 2019 (UTC)
