It seems to be more complicated than described

This brief article seems to accurately encapsulate the popular understanding of Enoch Arden laws, but the Cornell Law site referred to says something quite different. There is no need for a special law allowing a surviving spouse to remarry; this is already taken care of by laws dealing with declared death in absentia. The Cornell site indicates that the purpose of Enoch Arden laws is grant the re-married spouse grounds for a divorce (if he/she wishes) in the unlikely event that the missing spouse returns.
