Capital murder trial
editIf the death penalty was mandatory for capital murder, why was there a penalty phase for the trial? I have read accounts of jurors saying that they chose the death penalty because life without parole wasn't available, but jurors presumably could have opted against the death penalty and the judge would have set a term of imprisonment? The section in the article needs citation and revision.
