As he never married, extremely unusual for a judge or senior lawyer at the time, it has been asked if he was gay. Was he? This has been speculated (e.g. in the BBC radio play) as why he made a great deal of the fact that lesbian relationships were not illegal but that homosexual relationships for men are.
