Aubrey was almost certainly the first child born to Aubrey III de Vere, first earl of Oxford, and his third wife Agnes, but there was a significant age difference between that couple and it is not clear whether their marriage was consumated before Agnes's father Henry of Essex was disgraced by being convicted of treason in early 1163. In that year she was only 12. Sometime before May 1166 the earl tried to divorce his young wife, now a political liability. Would he have done so if she had given birth to a son already? He might have, following the example of his brother-in-law Hugh Bigod, earl of Norfolk, who had divorced Aubrey's sister Juliana despite the fact that she had given birth to a son. The divorce decision was delayed by Agnes's appeal to the pope, who eventually decided in favor of Agnes and the validity of her marriage to the earl of Oxford. That decision was made in or before 1172. If Agnes had not given birth to her son Aubrey before 1166, she did so soon after 1172. Other evidence suggests that Aubrey IV was either the same age as King John (b. 1166) or perhaps just slightly older, not six years younger.DeAragon 03:52, 26 February 2007 (UTC)
