Leaked/Track Times

This album leaked on the 27th April, though I don't know what Wikipedias policy is on mentioning leaks (do we wait for a while or until the album's released or what?).

The track times listed might not be accurate, as they are taken from the leaked tracks which were ripped from an online flash player, some tracks have quite long gaps at the end for example which might not be the case on the CD. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use.
