Hi James, the Garda Síochána are the national police force, the Airport Police are a seperate entity.Heggyhomolit (talk) 02:23, 21 October 2010 (UTC)Reply

As James said, the word 'Police' means nothing in Irish law and thats why the airport police can use the term. If they used the word 'Garda' or 'Gardai' they would be impersonatinga member of An Garda Siochana. - Karl C

recent changes edit

Hi, I rolled back a number of recent changes by an IP address that seemed to strongly alter the article although no references were provided. Removal and amendment---------

I have removed the paragraph that stated the airport police prosecute hundreds of cases per year for public order, fraud etc. There is no evidence that the airport police prosecute any cases in the district court nor are they permitted in law to prosecute criminal matters as all detained / arrested persons MUST be handed over to Gardai. Logic dictates then that its the Gardai that prosecute.

I have also amended their powers and removed the part that stated they could demand biographical information as they cannot and have changed the power of arrest and detention section to more clearly show how and when that power can be used. The old paragraph led people to believe that they could detain for questioning etc whereas the reality is they detain pending Garda arrival similar to a security guard utilising Section 4 of the Criminal Law Act 1997. — Preceding unsigned comment added by 109.76.85.238 (talk) 14:01, 31 October 2012 (UTC)Reply

Section 33 power to detain is totally separate then a Section 4 CLA 1997 Citizen's Arrest. The power to stop & detain is only granted to the Gardai & Airport Police on airport lands as I referenced. Power to stop & detain a person can be employed to conduct a search, gather Biographical information which includes power to demand Name & Address and question a person in relation to their business on a airport,property in their pocession etc.. again as referenced in the act of 1988. The page also already mentions the requirement to transfer custody of a prisoner of the APS to the Gardai already I don't see the need for you to add it several times it makes the page untidy.

The arrested person civil liberty are withdrawn on arrest and they are then in custody of the Authorised officer who will bring the prisoner to their custody suite within the police station where they will then transferred to Gardai. During any period prior to this handover to the state police the prisoner whilst in airport police custody treatment & care must be fully human rights compliant. Please don't post that the airport police & it's officers are similar to shop security as they are not.

Section 33 (2) and I quote "Where an authorised officer, who is not a member of the Garda Síochána, arrests a person under this section, he shall, forthwith, deliver such person into the custody of a member of the Garda Síochána to be dealt with in accordance with law."

theres no mention of prosecutions in the act that I can find. THe only prosecutions are for aerodrome and aircraft offences not within the remit for authorised officers in the first place. Im sorry but the powers are marginally more potent than citizens arrest as you call it in that they also allow powers of search and demanding of information, however anyone that refuses to answer still has to be handed over to Gardai. Do not blame me for the stupid scenario that exists in Irish airports. In regards references, I cant reference what does not exist.
