The claim that 37 refers to "37 people out of 40..." differs from the information here: [1]http://www.stanleymilgram.com/trivia_answers.php?qdate=2000-06-01

That page states that the "37" actually refers to the 37.5% of people that were disobedient (those that did not "do what they were told") and that in fact the data was actually reported using the 62.% of people that did obey. Who do we believe here?

I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use.
