Fair use rationale

The Masked Rider says this statue was created in 2000. That would make it still copyrighted, and this photo a {{derivative}} work - i.e. fair use. I would tag it as such, but it's currently protected (and of course, as fair use it shouldn't actually be on the main page). --dave pape (talk) 02:49, 9 September 2008 (UTC)
