I copied a lot of this from the justification for the photo of Judge Horton. I see there is a lot about him down in the history part. I cannot find a way to get at that language to delete or modify it.

I think this page may be using the wrong non-free fair-use template (this is not a famous historic image; my understanding is that that template is for images whose source is well known.) I believe that Template:Non-free_fair_use_in may be more appropriate --RolandYoung (talk) 23:37, 14 November 2009 (UTC)Reply

Image Copyright edit

This image was used in today's (22 November 2013) New York Times article Alabama Pardons 3 ‘Scottsboro Boys’ After 80 Years. The photo's copyright is shown there as being held by Bettman/ Corbis, which the fair use justification for the use of the image on Wikipedia does not mention. Also, the fair use justification as it is given appears to contain several gaps: the justification refers to "the web site" where the image was derived from without having actually provided that web site; it refers to a law professor without naming him/ her or adequately explaining how he/ she makes his/ her own fair use claim for it; it states that the original author of the image is a man named Fred Hiroshige, but the link to prove this does not mention him anywhere; the image is clearly not in the public domain, and given that the copyright holder has now been identified, I am not convinced that a fair use justification actually exists, at least not based on the arguments put forth in the existing image description. I am going to go ahead and take this to the Media Copyrights Questions Desk to begin a dialogue on the status of this photo on Wikipedia, and see where that takes us.
