This is allowed under the WP:NFCI #10 "Photos of dead people, where (since they're dead) you're not likely to get a free image" rule. Anyway, it's a historical photo. The Nazis took it, so the copyright now belongs to the Federal Republic of Germany. It's only used in the one article. You didn't ask, but the commercial opportunities for this small, mediocre photo of a very obscure general is presumably minimal.
