The Gabriel Kuhn case refers to the murder of Gabriel Kuhn, a 12-year-old boy, who was dismembered by his supposed "friend", who was just 16 years old, which took place in the neighborhood of Velha Central, Blumenau, Santa Catarina, on the morning of July 23, 2007.

According to testimony from the killer, Daniel Petry, the cause of the conflict was an "argument" during a computer game. It was later confirmed that Daniel had lied in his testimony and that the disagreement between his colleagues was motivated by sexual abuse, confirmed in the necroscopic report, and not by a computer game.[1][2][3][4]

The killer, Daniel Felipe Petry, 16 years old at the time, was sentenced to a maximum sentence of three years determined by the Child and Adolescent Statute (ECA) and requested in the Public Prosecutor 's Office complaint. The sentence was handed down by judge Álvaro Luís Pereira de Andrade, from the Children and Youth Court of Blumenau.[5]

Gabriel Kuhn, born on March 21, 1995, was the son of Doroteia Alessandra Zuque Kuhn and Adelar Kuhn. He was considered a good boy, who was always quiet and polite.

Unlike his killer, Daniel Petry, who from an early age showed himself to be an aggressive, withdrawn and problematic person.[6] Daniel's family tried repeatedly to place him in psychological treatment, but nothing was effective.

A common fact that brought the boys close was that they both played the online MMORPG game Tibia, in addition to both living in the same neighborhood.

On the morning of July 23, 2007, a Monday, at 8:30, Gabriel and Daniel were alone, which was unusual. That day Gabriel was alone because his parents were working and his brother was at a dentist appointment, while Daniel's mother was at a friend's house in Nova Trento and was taking tranquilizers when news about the crime was reported. Gabriel's parents even doubted his responsibility, not understanding how he had the courage to kill him.[7] While the two were alone in the house, at 9:30, Daniel called his mother and asked what time she would be back, a few minutes after the call, Daniel pushes Gabriel and hits him unconscious, then takes him to the bedroom and sexually abuses him. The boy, regaining consciousness, screams for help and threatens to tell his parents everything that had happened, generating an argument that would take him from the bedroom to the kitchen, leaving Daniel even more angry, from then on, he strangles him, causing him to lose consciousness. , this time in a deeper way. Believing that Gabriel was dead, Daniel wrapped the body in wires in an attempt to suspend him to the attic, which was 1.8m above the ground.[8] As the body was very heavy, Daniel unable to get up, he soon decides to dismember him to facilitate the process, using a knife and a knife he begins to cut Gabriel's legs, who in the middle of the action regains consciousness and screams for help, but loses consciousness due to the shock. From then on, Daniel again tries to hide the body in the attic, but ends up giving up and abandoning the body in front of the door of his house.

Around noon, the victim's brother, Guilherme Kuhn, aged 16, who was returning from the dentist, arrived home, but the door was locked. So he went to the killer's house and found his brother's body. He ran out screaming for help and neighbors called the authorities, who captured Daniel, who was very anxious inside his home.[9]

The image of a mutilated Gabriel was recorded by a witness, photos of the crime scene were leaked on various internet forums, and a police investigation was even opened to investigate who spread the photos.[10]

The police closed the case in 3 days, much faster than expected. The hypothesis of an accomplice was also ruled out, which was one of the rumors circulating in the neighborhood, which left some people suspicious about the rigor of the investigations.


One of the first people to arrive at the scene of the crime was deputy Rosi Serafim, who even before the investigation was carried out, already suspected that sexual abuse had occurred, due to the messy state of the bed and furniture in the juvenile criminal's room. This led the delegate to request a necroscopic examination, which was later confirmed by the IML.[11] The report indicated that Gabriel died due to a hemorrhage caused by the cut and was sexually abused twice (once when he was already dead).[12]

Daniel only confessed to the crime after the autopsy, however, he denied having abused Gabriel, claiming he was not gay. In his statements to the delegate, Daniel said that, after a fight over a computer game called MMORPG Tibia, he had become angry and strangled Gabriel.

Despite this, the forensics stated that Daniel had raped Gabriel in the bedroom's bed and this possibly made Gabriel try to defend himself and threaten to tell his parents, which led to an argument between the bedroom and the kitchen, making Daniel even angrier. Daniel choked Gabriel, as confirmed by forensic examination, and dragged him to the corridor, where he dismembered him, with Gabriel still alive. Daniel even tried to lift the body by tying cables so that he could suspend and hide the corpse in the basement, which was 1.8m above the ground. That was when Daniel was unable to lift the body and left it at the front door until the victim's older brother found it.

For experts, the murder would not have been the consequence of an argument in the game but rather of sexual abuse committed by Daniel. The victim's brother arrived soon after and found the body at the entrance of the house, he then ran to the street and asked for help from a neighbor who called the police in light of the whole situation.

Internment and release edit

Daniel Petry was taken to the Child and Adolescent Protection Police Station, accompanied by his father and the family's lawyer, who, after 24 hours of testimony, was taken to the Legal Medical Institute and finally presented to the Public Ministry, where the Children and Youth prosecutor from Blumenau, Mônica Papst, requested provisional hospitalization for 45 days until the end of the investigations.[13] Daniel was admitted to a Provisional Detention Center for Juvenile Offenders (CIP) in Itajaí, Santa Catarina.

On September 6, 2007, Daniel Felipe Petry was sentenced to the maximum penalty provided for in the Child and Adolescent Statute (ECA) of three years' imprisonment and was taken to a Socio-Educational Service Center (CASE) in Lages. The sentence was handed down by judge Álvaro Luís Pereira de Andrade, from the Children and Youth Court of Blumenau.[14]

In 2010, Daniel Petry was released, when he was 19 years old, and his whereabouts were never heard from again, as the process remained confidential.
